These Terms of Service ("Terms") are an agreement between you and TrySpree ("TrySpree," "we," "us" or "our"). They cover your use of tryspree.com and everything on it (the "Site"). By using the Site you agree to these Terms. If you don't agree, please don't use the Site.
1. What TrySpree Is
TrySpree lists free samples, freebies and promotional offers from brands and retailers, and lets members comment on, like and share them. TrySpree does not make, own or ship these products. Each offer is run by the company behind it, which decides who qualifies and whether a sample is sent. Members can request a sample themselves, or ask TrySpree to submit the request for them with "TrySpree It!" (section 6). Some listings are written or illustrated with the help of AI tools and may contain mistakes.
2. Who Can Use TrySpree
Anyone can browse offers without an account. You must be at least 18 years old to create an account. Most offers are only open to U.S. residents, and many have their own age or location limits.
3. Your Account
Your TrySpree account also works on FreebieAgent, because both sites share one account system. You agree to:
- give accurate, current and complete information, and keep it up to date;
- keep your password secure and not share your account;
- take responsibility for activity under your account; and
- tell us right away at info@tryspree.com if you think someone else is using it.
You can delete your account at any time from your Profile page. This deletes it on both TrySpree and FreebieAgent. We may suspend or close an account that gives false or misleading information, breaks these Terms or abuses the Site, and may refuse a new account to someone we have removed.
4. Rules for Using the Site
You agree not to:
- break any law or anyone else's rights;
- give false information, or request offers you aren't eligible for, including by using several accounts;
- post spam, ads, hateful, harassing, sexual or illegal content, or other people's personal information;
- try to get into accounts or systems you aren't allowed to access, or upload malicious code;
- scrape, copy or harvest the Site's content or data with automated tools; or
- interfere with how the Site works.
5. What You Post
Comments, offers you post, your username and your avatar are public. You keep ownership of what you post, but you give us a worldwide, royalty-free, non-exclusive license to host, show, copy, adapt and share it to run and promote the Site. You confirm that you have the right to post it. We may edit, hide or remove anything posted on the Site at our discretion.
If you send us ideas or suggestions, we may use them freely without owing you anything.
6. Automatic Claiming ("TrySpree It!")
Some listings have a "TrySpree It!" button. When you click it and confirm, you ask TrySpree to request that one sample for you: our automated software fills out and submits the offer's request form on the company's website, using the details saved in your profile (such as your name, email address, mailing address, phone number and birthday).
By using "TrySpree It!" you appoint TrySpree as your limited agent for that single request. This permission:
- covers only the specific offer you confirm, at the time you confirm it;
- lets us send the profile details that offer's form asks for to the company running it, and submit the form for you;
- does not let us start paid subscriptions or buy anything. If an offer needs an account with the company, it lets us create one in your name, with a password we make and show you on your Claimed page; and
- ends for future requests whenever you stop using the button. Requests already submitted are not affected.
The company receives your details as if you had sent them yourself. Any relationship that results is between you and that company, not TrySpree. If the company's form requires agreeing to its terms or privacy policy, or ticking a consent box, to submit, confirming "TrySpree It!" means you agree to them. So please read them first, and don't confirm if you don't agree.
You are responsible for keeping your profile accurate and truthful, for being eligible for each offer (age, location, one per household and similar limits), and for following each company's rules.
Our software fills out and submits forms using a standard web browser, so a website may not be able to tell a request from one you made yourself. Some websites don't allow automated requests. Don't use "TrySpree It!" on an offer whose terms you know forbid it; if you do, you are responsible for what follows. Companies may reject, ignore or block automated requests, and may also limit your future requests with them. We don't guarantee that any request is accepted or that any sample arrives. You can always request any offer yourself instead, with the "Get Sample" button.
We may limit how often "TrySpree It!" can be used, and may change or stop offering it at any time.
7. Offers and Other Websites
Offers and links lead to websites we don't run or control. We try to keep listings accurate and remove expired ones, but offers change or end without notice, and we don't guarantee that any offer is available, free, accurate or safe. TrySpree never charges you for samples. If a website asks for payment, a credit card or shipping fees, that is between you and that company. Your use of other websites is at your own risk and under their terms and privacy policies. We may earn money from ads or from some links on the Site.
8. Emails and Notifications
If you sign up, we send emails about new free samples and occasional emails to past members. Every marketing email has an unsubscribe link. You can turn off browser notifications at any time. We may also send account and service emails, such as password resets.
9. Our Content
The Site's design, text, graphics, logos and arrangement belong to TrySpree or its licensors and are protected by copyright, trademark and other laws. You may view and print pages for your own personal, non-commercial use. You may not copy, republish, sell or build on them otherwise without our written permission.

Our Privacy Policy explains how we handle your information and is part of these Terms.
11. Disclaimer
THE SITE, ITS CONTENT AND "TRYSPREE IT!" ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT. WE DON'T PROMISE THAT THE SITE WILL BE ACCURATE, UNINTERRUPTED OR ERROR-FREE, OR THAT ANY OFFER, REQUEST OR SAMPLE WILL BE AVAILABLE, ACCEPTED OR DELIVERED.
12. Limitation of Liability
TO THE FULLEST EXTENT THE LAW ALLOWS, TRYSPREE AND ITS OWNERS, STAFF, PARTNERS AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA OR GOODWILL, ARISING FROM YOUR USE OF THE SITE, ANY OFFER, ANY THIRD-PARTY WEBSITE OR PRODUCT, OR ANY REQUEST SUBMITTED FOR YOU, EVEN IF WE WERE TOLD THEY WERE POSSIBLE. OUR TOTAL LIABILITY FOR ANY CLAIM IS LIMITED TO THE GREATER OF THE AMOUNT YOU PAID US IN THE PAST 12 MONTHS OR $50. Some places don't allow these limits, so they may not fully apply to you.
13. Indemnification
You agree to defend and hold harmless TrySpree and its owners, staff, partners and affiliates from any claims, losses and costs (including reasonable attorneys' fees) arising from your breaking these Terms, your posts, the information you provide, or your misuse of the Site or "TrySpree It!".
14. Governing Law and Venue
California law governs these Terms, without regard to conflict-of-law rules. Any dispute about these Terms or the Site will be brought only in the state or federal courts in San Diego County, California, and you and we agree to those courts' jurisdiction.
15. Changes
We may change these Terms or the Site at any time. We will post the new Terms here and update the date above. For a material change, we will give extra notice, such as an email or a notice on the Site. If you keep using the Site after a change takes effect, you accept the new Terms.
16. General
These Terms and the Privacy Policy are the whole agreement between you and us about the Site. If any part is found unenforceable, the rest still applies. If we don't enforce a term, we haven't given up the right to enforce it later. You may not transfer your rights under these Terms; we may transfer ours as part of a merger, sale or reorganization.
